1. Introduction

Welcome to Mandy Meyer Online Coaching (“Company”, “we”, “our”, “us”)!

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at mandymeyer.com (together or individually “Service”) operated by Mandy Meyer Online Coaching.

2. Coaching

Health/wellness and/or fat loss coaching is not intended to diagnose, treat, prevent or cure any disease or condition. It should not be a substitute for the advice, treatment and/or diagnosis of a qualified licensed professional. I, Mandy Meyer, as your coach may not make any medical diagnosis, claims, or substitute for your personal physician’s care.

As your health/wellness/fat loss coach, I do not provide a second opinion or in any way attempt to alter the treatment plans or therapeutic goals of your personal physician or healthcare team. It is my role to partner with you to provide ongoing support, resources and accountability as you create an action plan to meet and maintain your weight loss goals.

3. Purchases

If you wish to purchase any product or service made available through our Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

We employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

4. Contests, Sweepstakes and Promotions

Any contests, sweepstakes, or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

5. Refunds

All services rendered by Mandy Meyer Online Coaching are provided on a non-refundable basis. There will be no option to roll over to the next group at no cost.

6. Content

Content found on or through this Service are the property of Mandy Meyer Online Coaching or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

7. No Use by Minors

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of Service.

8. Intellectual Property

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Mandy Meyer Online Coaching and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Mandy Meyer Online Coaching.

9. Error Reporting and Feedback

You may provide us either directly at mandy@running4meyer.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”).

10. Links To Other Web Sites

Our Service may contain links to third party web sites or services that are not owned or controlled by Mandy Meyer Online Coaching.

Mandy Meyer Online Coaching has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

11. Effective Date

This agreement shall commence on the date of the start of the program.

12. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using Service.

All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If you fail to check-in for 3 weekly check-ins’, your service will be terminated.

13. Provider’s Obligation

Upon payment of the Fee, the Provider shall provide the Services as selected by the Client from the Website

14. Clients Obligations

14.1. The client shall accept our terms & conditions prior to starting the program.

14.2.The client ensures that the information and Personal Data given to the Provider at the Commencement Date are true and honest.

14.3. The client shall co-operate with the Provider in all matters relating to the Services including but not limited to your physical and fitness capabilities.

14.4. The client must have internet access, a smart phone, and a Facebook profile to be able to access the course material.

14.5. The client must use appropriate means of contact regarding course material, and not contact us via social media for this.

14.63 The client must be willing to ask for help and not keep any problems quiet.

14.7. The client agrees to communicate as much as possible.

14.8. The client acknowledges and accepts that all advice given from the provider is based on personal experience.

14.9 The client enters the program at their own risk, and the Provider will take no responsibility for injuries.

14.10. If you are pregnant, undertaking fertility treatment or recovering from any surgery, exploratory or otherwise, you have had confirmation you are safe to take part in the program by a Medical Professional and have let the Provider know your situation. If you become pregnant after commencement of the program, you are obligated to seek medical advice regarding if you can continue with the program and you must let the Provider know of this and any adjustments needed to be made to your plan.

14.11 The client agrees to be honest with food consumption, daily check-ins and weekly check-ins.

15. Amendments To Terms

We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.

16. Acknowledgement

By using this service or other services provided by us, you acknowledge that you have read these terms of service and agree to be bound by them.

At Mandy Meyer Online Coaching we are committed to protecting your privacy and to ensure that your personal information is collected and used properly, lawfully, and transparently. By providing us with your Personal Information, you agree to this Privacy Policy and authorise us to process your Personal Information for the purposed outlined within this Privacy Policy.

2. Personal Information that Mandy Meyer Online Coaching collects and holds

We collect information directly from you where you provide us with your personal details.  Where possible, we will inform you what information you are required to provide to us and what information is optional.

Information collected:

1. Name and/or username;
2. Date of birth
3. Gender;
4. Email address;
5. Profile photo;
6. Password to your account;
7. Information collected through the use of cookies as set out in, and in accordance, with our Cookies Policy at https://www.mandymeyer.com/cookies;
8. Information and data about you received from third party services and organizations – including but not limited to the Justcoach App, and Facebook;
9. Information about any complaints you may lodge; and
10. Information about or related to your journey for the duration you are signed up for.

Information related to signing up to Mandy Meyer Online Coaching is, including but not limited to billing address, phone number and payment information such as a credit card number is processed by our third-party processors and we do not collect, store or maintain your Financial Information unless we tell you otherwise at the time of your purchase.

3. Health Information & Sensitive Information

Given the nature of our business as provider of online health & fitness resources, we may also collect some sensitive information about you, for example, information about your health.

Includes the following information as “health information”:

1. Information or an opinion about the health (including illness, disability or injury) of an individual);
2. The individual’s expressed wishes about the future provisions of health services provided to him or her; or
3. Personal information which is collected as part of providing a “health service”, collectively, ‘Health Information’.

Health Information which we might collect about you includes, but is not limited to:

1. Any medical issues (as may be relevant to your use of services we provide to you);
2. Your current height, weight, BMI and measurements;
3. Information and data about you received from you during your check-in’s.
4. Activity data, such as step count, sleep cycle, nutrition and workouts;
5. Progress management – a weekly photo of you, and record of height, weight, measurements and similar information, as you work towards your goals through our program;
6. Progress management – a record of your progress in weekly submissions.
7. Your daily calorie requirements calculated using the calorie calculator on our website or justcoach app;
8. Your specific nutritional requirements;
9. Description of your fitness and nutrition goals; and
10. Any other information required for the provision of our programs to you.

We will not collect, use or disclose any of your Health Information except to the extent necessary to provide a health service to you through our programs, and will ensure that any Health Information is collected, used and disclosed only in accordance with rules established by other competent health or medical bodies (where applicable) that deal with obligations of professional confidentiality.

4. Third Party Payment

When you make purchases through our website your payments are processed by a third party processor.

The third party processor may collect certain Financial Information from you to process a payment on behalf of Mandy Meyer Online Coaching, including your name, email address, address and other billing information in which case the use and storage of your Financial Information is governed by the third party processor’s terms, conditions and privacy policies. All payments are done through PayFast whom have their own Privacy Policy. This can be viewed on their website.

5. How Mandy Meyer Online Coaching Collects and Holds your Personal Information

We may collect Personal Information from you directly in the following ways:

1. If you sign up for one of our programs;
2. If you participate in promotional offers;
3. If you choose to subscribe to our mailing list;
4. If you disclose information such as contact details via our website.

We take reasonable steps to:

1. Protect your Personal Information from misuse, interference and loss and from unauthorised access, modification or disclosure;
2. Destroy or de-identify Personal Information when it is no longer required.

6. The Purpose for Which Mandy Meyer Online Coaching Collects your Personal Information

Personal Information which is collected by Mandy Meyer Online Coaching will be held, used and disclosed by us for the primary purpose of providing health and fitness regimes to our customers including:

1. Personalizing our programs to help you achieve your individual fitness goals;
2. Formulating our programs to suit your individual health requirements;
3. Providing you with the tools necessary to determine your nutritional requirements and track your food intake;
4. Sending you an email to notify you of any account changes or updates to our services (such as coach updates to our user programs, group comments, or weekly check-ins);
5. Supporting and enhancing our relationship with you
6. To provide insights into the progress and experiences of Mandy Meyer Online Coaching members.

Mandy Meyer Online Coaching does not sell any of your Personal Information to third parties.

8. Duration we hold onto your Personal Information

We will only retain your Personal Information for as long as necessary to provide our services to you.

10. Access, Correction or deletion of your Personal Information

You have a right to request access to your Personal Information and/or Health Information and to request its correction and/or deletion, by emailing us at mandy@running4meyer.com. Your health information is only stored for the duration of your program/membership. It is deleted upon your completion with Mandy Meyer Online Coaching services.

11. Children

The services offered by Mandy Meyer Online Coaching are not intended for or available to individuals under the age of 18.
